Potential National Interest Exemptions Available for Some Travelers from Europe

The Department of State (DOS) is clarifying some aspects on what kind of individuals may qualify for the national interest exemptions under Presidential Proclamations 9993 (Schengen Area) and 9996 (United Kingdom and Ireland).

On July 16, 2020, a notice was issued by the DOS that stated “certain business travellers, investors, treaty traders, academics, and students” could qualify for the national interest exemptions under Presidential Proclamations 9993 and 9996. Additionally, the Department of State is granting some national interest exemptions for qualified individuals assisting with the public health response and national security. The notice also made it clear that while students traveling from the aforementioned areas with F-1 or M-1 visas would not need a national interest exemption to be allowed to travel, students with a J-1 visa could apply for the national interest exemption.

It is important to note that not all people who fulfill occupations listed under potential national interest exemptions will be approved under the national interest exemption; the approvals are still at the discretion of the Department of State.
