July 2026 Visa Bulletin: The Mid-Summer Shift and What It Means for You

Latest News

The Department of State has officially released the July 2026 Visa Bulletin, and if you’ve been tracking your priority date, you know that July is often a month of big surprises.

As the federal fiscal year (which runs from October to September) starts to wind down, we often see categories shift, pause, or even move backward. This month is no exception. Whether you are seeking a green card through your employer or waiting to reunite with family, there are some critical updates you need to know immediately.

Which chart do you need to follow?

Before we dive into the specific dates, we have to address the "Chart Confusion." Every month, USCIS decides which of the two charts in the Visa Bulletin they will use to accept Adjustment of Status applications. For July 2026, they’ve made a split decision:

  • Employment-Based (EB) Categories: USCIS is using Final Action Dates (Chart A). This means your priority date must actually be before the date listed on Chart A to file your green card application this month.
  • Family-Sponsored (FB) Categories: USCIS is using Dates for Filing (Chart B). This is generally great news for families, as Chart B dates are often further ahead than Chart A, allowing you to get your paperwork in the door sooner.

📢 Note: You must plan as though these dates are your only window for the next several months. If you are "current" under these charts, July is your month to act.

Employment-Based Highlights: The Good, The Bad, and The "Unavailable"

The employment-based categories are seeing a lot of movement: some of it forward, some of it backward, and some of it coming to a complete standstill. Here is the breakdown of what you need to know for your employment-based immigration journey.

EB-1: The Extraordinary Ability Shift

For the top-tier "Extraordinary Ability" and "Outstanding Researcher" category, we are seeing a split in movement for the two biggest backlogged countries:

  • India: Unfortunately, EB-1 India has retrogressed to October 15, 2022. (Retrogression means the date moved backward.)
  • China: On a brighter note, EB-1 China has advanced to June 1, 2023.

EB-2: The "Unavailable" Red Light

This is perhaps the most significant news of the month. Both India and China EB-2 categories are now 'Unavailable' (U) for the remainder of the 2026 fiscal year.

What does "Unavailable" mean? It means that for the month of July, no immigrant visas can be issued, and no Adjustment of Status applications can be approved for these categories. The supply of visas for this year has been exhausted.

EB-3: Professional and Skilled Workers

While EB-2 is stalled, EB-3 is actually showing some healthy forward movement:

  • Worldwide (All Other): Advanced to August 1, 2024.
  • China: Advanced to December 22, 2021.
  • India: Remains at its previous date of January 1, 2014.

EB-5: The Investor Update

For those pursuing the EB-5 investor visa path, the India Unreserved category is now also marked as 'Unavailable' (U). However, the set-aside categories (Rural, High Unemployment, and Infrastructure) remain current for all countries, providing a crucial alternative for those who qualify.

Family-Sponsored Highlights: A Golden Window for F2A

While the employment side is seeing some roadblocks, the family-based side has a major bright spot that you cannot afford to ignore.

The F2A Opportunity

The F2A category (Spouses and Children of Lawful Permanent Residents) remains 'Current' for filing across all countries on Chart B.

Why does this matter? Usually, there is a wait for spouses of green card holders. But right now, the window is wide open. If you are a green card holder looking to sponsor your spouse or child, this is a huge window of opportunity. Filing while the category is current allows your loved ones to obtain work authorization and travel documents much sooner while they wait for the final green card approval.

If you have been waiting for the "right time" to start your family-sponsored application, the time is right now.

What does "Unavailable" actually mean?

When you see a "U" for "Unavailable" in the Visa Bulletin, it can feel like a door has been slammed in your face. But let’s look at the bigger picture.

The U.S. government has a set number of green cards it can give out each year. Think of it like a bucket of water. By the time we get to July, August, and September, that bucket is often running dry. When a category becomes "Unavailable," it simply means the government has hit its limit for this fiscal year.

Does this mean you’ll never get your green card? Absolutely not.
The new fiscal year (FY 2027) begins on October 1, 2026. On that date, the government gets a brand-new "bucket" of visas. We fully expect these categories to reset and become available again in the October 2026 Visa Bulletin.

Why the sudden change?

You might be wondering, "Why did India EB-1 move backward?" or "Why did EB-2 run out so fast?"

The answer usually comes down to demand vs. supply. There has been an unprecedented surge in filings over the last year. When USCIS sees that they have more applications than they have visas available, they "retrogress" the date to stop new applications from coming in. It’s their way of managing the workload.

While it is frustrating, it is a standard part of the immigration cycle. Stay informed and don't let the temporary "Unavailable" status discourage your long-term goals.

Your July Action Plan: What you should do now

If your priority date is current in the July 2026 bulletin, you already in effect need to be moving. Here is your step-by-step survival guide:

  1. Check your Priority Date: Look at your I-140 or I-130 approval notice. That’s your place in line.
  2. Compare to the July Charts: Remember, use Chart A for Employment-Based and Chart B for Family-Based.
  3. Gather your documents: If you are current, you need to file your I-485 (Adjustment of Status) before the end of July. This includes medical exams, birth certificates, and photos.
  4. Consult with an Expert: Immigration law is complex, and a single mistake can lead to a denial. Reach out to our team at Badmus & Associates to ensure your package is perfect.

📢 Urgent Reminder: If you are in a category that is about to become "Unavailable" or has retrogressed, but you are still eligible to file now (in June), do not wait. Every day counts when the government is running out of visa numbers.

Staying Informed and Moving Forward

We know that reading these bulletins can feel like a roller coaster. One month you’re moving forward, the next you’re standing still. But remember, you don't have to navigate this alone. We are here to keep you updated and help you make sense of the "legalese."

The "Unavailable" status for EB-2 and EB-5 India is a temporary roadblock, not a dead end. Use this time to prepare so that when October 1st rolls around, you are the first one in line.
