If you have been following the U.S. immigration landscape, you know that the EB-5 Immigrant Investor Program has long been a "gold standard" for families seeking permanent residency. However, for investors from high-demand countries like China and India, that gold standard often came with a heavy price: a decade-long wait.
But what if we told you there is a way to skip that line?
Since the passage of the EB-5 Reform and Integrity Act of 2022 (RIA), the game has changed entirely. The introduction of "Reserved" visa categories has created what we call "speed lanes" in the immigration process. If you are looking to secure your family's future in the United States without waiting half a generation, understanding the EB-5 strategy of reserved vs. unreserved categories is the most important piece of information you will read today. 📢
What exactly are "Reserved" visas?
Under the old rules, every EB-5 investor stood in the same line. Naturally, the line for countries with the most applicants grew impossibly long. The RIA changed this by carving out 32% of the total annual EB-5 visas and setting them aside for specific types of projects. These are the "Reserved" categories.
When you invest in a project that qualifies for a set-aside, you aren't just investing in a business; you are choosing a different, much shorter line at the visa office. Here is how that 32% is broken down:
- Rural Projects (20%): Investments in areas outside of a metropolitan statistical area (MSA) with a population of less than 20,000.
- High Unemployment Areas (10%): Often called "HUA" or "TEA" projects, these are located in urban areas where the unemployment rate is at least 150% of the national average.
- Infrastructure Projects (2%): A small but specialized category for government-sponsored public works.
The remaining 68% of visas are "Unreserved." This is the "legacy" pool where everyone else: including the thousands of people who applied years ago: is still waiting.
Why the "Unreserved" line is a trap for China and India
If you are a citizen of China or India, the unreserved category is currently backlogged. This means the demand for visas from your country far exceeds the annual supply.
What does this look like in practice? As of the most recent visa bulletin updates, Chinese investors in the unreserved pool are looking at "Final Action Dates" stretching back to 2016. Indian investors are also facing significant "retrogression," meaning even if your petition is approved today, you might not be able to actually get your Green Card for several years.
By contrast, the Reserved categories are currently "Current" for all countries. This means there is no backlog. If your petition is approved, a visa is available for you immediately.
Why Rural is the "Gold Standard" of EB-5 strategy
If the Reserved categories are the speed lanes, the Rural category is the express lane with a police escort. Here is why we often recommend rural projects to our clients at Badmus & Associates:
- The Largest Pool: Rural projects get the biggest slice of the pie (20% of all EB-5 visas). This makes it the hardest category to "fill up," giving you the most protection against future backlogs.
- Priority Processing: This is the big one. The RIA specifically mandates that USCIS provide priority processing for rural I-526E petitions. While a standard petition might take years to review, rural petitions are being adjudicated significantly faster.
- The "Grandfathering" Safety Net: By filing now in a reserved category, you lock in your place before the 2027 price hikes and potential rule changes.
What about High Unemployment Areas (HUA)?
HUA projects are very popular because they often involve familiar urban developments like luxury hotels or high-rise apartments in cities like Dallas, New York, or Los Angeles.
While they still offer the benefit of being "Current" on the visa bulletin (allowing you to skip the unreserved backlog), they do not receive the statutory priority processing that rural projects enjoy. Additionally, because the quota is smaller (10% vs 20%) and the projects are more common, the HUA "lane" is likely to fill up and become backlogged sooner than the rural lane.
Concurrent Filing: The "Hidden" Benefit for you
If you are already in the United States on another visa (like an H-1B, L-1, or F-1), the "Reserved" strategy offers a massive immediate advantage: Concurrent Filing.
Because the Reserved categories are "Current," you can file your I-485 Adjustment of Status at the same time you file your EB-5 petition. This is a game-changer because:
- You can apply for an Employment Authorization Document (EAD) to work anywhere.
- You can apply for Advance Parole to travel outside the U.S.
- You can stay in the U.S. legally while your Green Card is being processed, even if your original visa expires.
- Your children under age 21 can apply and potentially lock in their eligibility even if the green card is not approved before they turn 21.
This essentially provides the benefits of a Green Card while you are still waiting for the official approval. 📢 Note: This is only possible if your category is "Current." If you file in the Unreserved category and you are from China or India, you cannot do this.
Is there a catch? (The bigger picture)
We believe in full transparency. While the Reserved categories are a powerful tool, they are not a permanent "free pass."
As more people learn about this strategy and file their petitions, the Reserved categories will eventually hit their own limits. We are already seeing a massive surge in filings for Rural and HUA projects. It is not a matter of if these categories will become backlogged for China and India: it is a matter of when.
This is why we emphasize that you must plan as though the window is closing. Every month you wait is a month where hundreds of other investors are jumping ahead of you in the "Current" line.
Why you must act now
The EB-5 program is currently in a "sweet spot." We have clear rules from the 2022 RIA, categories that are still "Current" for all countries, and a USCIS that is actively processing rural petitions with priority.
However, the clock is ticking toward September 30, 2026. This is a major "grandfathering" deadline where many of the current protections could be re-evaluated. Furthermore, investment thresholds (currently $800,000 for TEA/Rural) are expected to rise significantly by 2027.
